These Terms & Conditions govern your access to and use of DisabilityHeroes.org, operated by Same Page Holdings LLC. Please read them carefully. They contain important provisions, including a binding arbitration agreement and class-action waiver, a limitation of liability, and disclaimers of warranties.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS SITE. BY ACCESSING OR USING DISABILITYHEROES.ORG, SUBMITTING ANY FORM, OR INTERACTING WITH OUR CHATBOT, YOU AGREE TO BE BOUND BY THESE TERMS.
By accessing DisabilityHeroes.org, using any of our services, or accessing any other website on which these Terms reside (collectively, the "Site"), or any of the Site's content (the "Content"), you acknowledge that you have read, understand, and agree to be bound by these Terms & Conditions, including without limitation the binding arbitration and class-action waiver provisions below, our Privacy Policy, and any operating rules, policies, and procedures published on the Site from time to time (collectively, the "Terms"). These Terms contain provisions that govern the resolution of disputes and that limit our liability to you.
If you do not agree to these Terms, you may not access or use the Site or the Content. These Terms constitute a legally binding agreement between you and Same Page Holdings LLC, doing business as DisabilityHeroes.org ("DisabilityHeroes.org," "we," "us," or "our"), including our agents, successors, and assigns. The Site is available only to individuals who can form legally binding contracts under applicable law, who are residents of the United States, and who are at least 18 years old.
1. Not a government agency.
DisabilityHeroes.org is a privately-owned informational service that helps consumers understand and pursue Social Security disability benefits (SSDI and SSI) and related programs. We are NOT affiliated with, endorsed by, or operated by the Social Security Administration (SSA), Medicare, Medicaid, or any federal or state government agency, and we are not a law firm, insurance company, or provider of professional advice. You can apply for and receive Social Security disability benefits (SSDI or SSI) for free, directly through the SSA at www.ssa.gov or by contacting the SSA. You are never required to use this Site to seek or obtain benefits.
Any dollar figures shown on the Site (for example, references to amounts such as "up to $4,152 per month") represent maximum potential federal benefit amounts and are provided for general informational and illustrative purposes only. They are not a promise, guarantee, or estimate of your eligibility, approval, or payment. Actual benefit amounts, if any, are determined solely by the SSA based on your individual circumstances.
2. Eligibility.
You represent and warrant that you are at least 18 years of age, are a resident of the United States, and have the legal capacity and authority to enter into these Terms. The Site is not directed to and may not be used by anyone under the age of 18.
3. Our services.
The Site is a first-party informational service that provides general information about disability benefits and related programs. When you request help, DisabilityHeroes.org and its own team and representatives will contact you by telephone, text/SMS, and email to provide that help. We are the sender of all such communications; we do not hand your request off to outside companies who then contact you on their own behalf. We do not provide benefits, and we do not represent or act on behalf of the SSA or any government agency. We do not guarantee that you will qualify for, be approved for, or receive any benefit, product, or service.
4. Informational only; no professional advice.
The Content on the Site is provided for general informational purposes only and does not constitute legal, medical, financial, tax, insurance, or other professional advice. Nothing on the Site creates an attorney-client, advocate-client, or fiduciary relationship. You should not rely on the Content as a substitute for advice from a qualified professional or from the SSA. If you need advice about your specific situation, please consult a qualified professional or contact the SSA directly.
5. No guarantee of benefits or approval.
We make no representation, warranty, or guarantee that you will be found eligible for, be approved for, or receive any disability benefit or any amount of benefit. Eligibility and benefit determinations are made solely by the SSA or the applicable program administrator. Any outcomes described on the Site are illustrative and are not a prediction of your results.
6. Telephone and SMS/text consent (TCPA).
By submitting your telephone or mobile number through the Site or our chatbot and checking or accepting the consent box, you provide your prior express written consent to receive recurring marketing and informational telephone calls and text/SMS messages FROM DisabilityHeroes.org at the number you provide, including calls and messages made or sent using an automatic telephone dialing system (autodialer) and pre-recorded or artificial voice technology. DisabilityHeroes.org is the sole sender of these calls and messages.
Your consent is NOT a condition of purchasing any goods or services or of receiving any assistance, and you may decline to provide it. Message frequency varies. Message and data rates may apply. You may reply STOP to any text message to opt out at any time, or reply HELP for help. Neither wireless carriers nor DisabilityHeroes.org are liable for delayed or undelivered messages.
You may revoke consent at any time by replying STOP to any text message, asking to be added to our internal do-not-call and do-not-text list, following the unsubscribe instructions in any email, or emailing privacy@disabilityheroes.org. The mobile opt-in information and consent you provide are NOT sold, rented, traded, or shared with any third parties or affiliates for their marketing or promotional purposes; that information is used only to deliver the calls and messages you requested and to comply with applicable law. 7. We do not sell or share your information.
We do NOT sell, rent, trade, or share your personal information with third parties or affiliates for their own marketing or promotional purposes. The only third parties who receive your information are service providers and processors acting on our behalf and under contract, strictly to operate our service and deliver the communications you requested, such as our website hosting, cloud storage, analytics (Microsoft Clarity), and telephone and SMS delivery providers. We may also disclose information to comply with the law or in connection with a business transfer. Please see our Privacy Policy for full details.
8. Third-party links.
The Site may contain links to websites operated by third parties, such as the SSA. We do not control and are not responsible for the content, products, services, privacy practices, or conduct of any third-party website. Inclusion of any link or reference does not imply our endorsement.
9. Acceptable use.
You agree to use the Site only for lawful purposes and to make legitimate inquiries. You agree not to submit false, fraudulent, or another person's information; not to interfere with or disrupt the Site or its security; not to use any robot, spider, scraper, or automated means to access or collect data from the Site without our prior written permission; and not to reproduce, republish, distribute, or create derivative works from the Content except as expressly permitted.
10. Intellectual property.
The Site and all Content, including text, graphics, logos, images, and software, are owned by or licensed to DisabilityHeroes.org and Same Page Holdings LLC and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use in accordance with these Terms. All rights not expressly granted are reserved. Our names, logos, and marks may not be used without our prior written permission.
11. Disclaimer of warranties.
THE SITE AND ALL CONTENT, SERVICES, AND MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE IS AT YOUR SOLE RISK.
12. Limitation of liability.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DISABILITYHEROES.ORG, SAME PAGE HOLDINGS LLC, OR THEIR OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ALL EVENTS, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification.
You agree to indemnify, defend, and hold harmless DisabilityHeroes.org, Same Page Holdings LLC, and their officers, directors, members, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your violation of these Terms, your violation of any law or the rights of any third party, or any information you submit through the Site.
14. Binding arbitration and class-action waiver.
PLEASE READ THIS SECTION CAREFULLY; IT AFFECTS YOUR LEGAL RIGHTS. You and DisabilityHeroes.org agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your relationship with us (a "Claim") will be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The Federal Arbitration Act governs the interpretation and enforcement of this provision.
The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by these Terms, before a single arbitrator. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate or join the claims of more than one person. By agreeing to arbitration, you and we waive the right to a trial by jury and the right to participate in a class action. If the class-action waiver is found unenforceable, then this entire arbitration provision will be null and void. Nothing in this Section prevents you from contacting a government agency, such as the Federal Communications Commission or Federal Trade Commission.
You may opt out of this arbitration provision by sending written notice to legal@disabilityheroes.org within thirty (30) days of first accepting these Terms, including your name, the phone number or email you provided, and a clear statement that you do not wish to resolve disputes through arbitration.
15. Governing law and venue.
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. Subject to the arbitration provision above, you agree that any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
16. Electronic communications and consent.
By using the Site, you consent to receive communications and disclosures from us electronically, including by email and by notices posted on the Site, and you agree that electronic communications and electronic signatures satisfy any legal requirement that such communications be in writing. You may withdraw this consent by contacting us, though doing so may prevent us from providing certain services.
17. Changes to these Terms.
We may modify these Terms at any time. When we do, we will post the updated Terms on the Site with a revised "updated" date. Changes are effective when posted. Your continued use of the Site after any change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.
18. Severability and waiver.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
